1. Acceptance of Terms

By accessing and using BlogFanatic ("Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Service Description

BlogFanatic is a Software as a Service (SaaS) platform that uses artificial intelligence to automatically generate and publish blog content. The Service operates on a monthly subscription basis with the option to cancel at any time.

3. Subscription and Billing

3.1 Free Trial: We offer a 14-day free trial period. No credit card is required during the trial. You may cancel at any time during the trial without charge.

3.2 Monthly Subscription: After the trial period, the Service is billed on a monthly subscription basis. Subscriptions automatically renew each month unless cancelled before the renewal date.

3.3 Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds will be provided for partial months.

3.4 Enterprise Bespoke Plan - Cancellation and Intellectual Property: For Enterprise Bespoke subscriptions that include custom development services, the following additional terms apply:

Notice Period: Cancellation of an Enterprise Bespoke plan requires three (3) months written notice to hello@blogfanatic.com. You remain liable for all fees during the notice period.
Intellectual Property Ownership: All software, code, features, integrations, custom developments, and intellectual property created by BlogFanatic during your Enterprise Bespoke subscription remain the exclusive property of BlogFanatic.com Ltd and its holding company, Moxon AI Group.
Purchase of Developed IP: Custom intellectual property developed specifically for your Enterprise Bespoke subscription may be purchased from BlogFanatic.com Ltd at an agreed fee negotiated in writing. Until such purchase agreement is executed and payment received in full, all rights remain with BlogFanatic.com Ltd.
License Grant: During your active Enterprise Bespoke subscription, you are granted a non-exclusive, non-transferable license to use custom developments. This license terminates upon cancellation or non-payment.

Important: These Enterprise Bespoke terms apply only to custom development work. Standard AI-generated content published through the Service remains subject to Section 6.2 below.

4. User Responsibilities and Content Review

4.1 Content Review: You are solely responsible for reviewing, editing, and approving all AI-generated content before publication. BlogFanatic is an automated content generation tool, and you must verify the accuracy, appropriateness, and quality of all content.

4.2 Content Accuracy: AI-generated content may contain errors, inaccuracies, outdated information, or misleading statements. You are responsible for fact-checking and ensuring the accuracy of all content published through our Service.

4.3 Content Liability: You accept full responsibility for all content published through BlogFanatic. We are not liable for any inaccurate, misleading, offensive, or harmful content generated by the AI system.

4.4 Prohibited Use: You may not use the Service to generate or publish content that is illegal, defamatory, fraudulent, misleading, discriminatory, or violates third-party rights including intellectual property rights.

5. No Guarantee of Results

5.1 No SEO Guarantees: We do not guarantee any specific search engine rankings, traffic levels, or SEO results. Search engine algorithms are constantly changing and beyond our control.

5.2 No Performance Guarantees: While we strive to provide high-quality AI-generated content, we make no guarantees regarding the performance, effectiveness, or success of the content for your specific purposes.

5.3 AI Limitations: AI technology has inherent limitations. Generated content may not always meet your expectations or requirements. Results may vary based on numerous factors outside our control.

6. Intellectual Property

6.1 Service IP: BlogFanatic and all related trademarks, logos, and technology remain our exclusive property.

6.2 Generated Content: You retain ownership of content published through BlogFanatic. However, you acknowledge that AI-generated content may lack originality and may be similar to content generated for other users.

6.3 Third-Party Rights: You are responsible for ensuring that your use of the Service and published content does not infringe on third-party intellectual property rights.

7. Limitation of Liability and Indemnification

7.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 Limitation of Liability

To the maximum extent permitted by law, BlogFanatic, its directors, employees, agents, and affiliates shall not be liable for any:

Inaccurate, misleading, defamatory, offensive, or harmful content generated by the AI system
Loss of data, revenue, profits, sales, business, or business opportunities
Damage to your reputation, brand, or goodwill
Loss of anticipated savings or earnings
Any direct, indirect, incidental, consequential, special, exemplary, or punitive damages
Search engine penalties, ranking losses, or algorithmic changes
Copyright, trademark, or intellectual property infringement claims arising from AI-generated content
Third-party claims related to published content
Service interruptions, downtime, or technical failures
Data breaches, security incidents, or unauthorized access (see Section 7.4)
Unauthorized use or misuse of your API credentials or website access
Any actions taken based on AI-generated content

Maximum Liability Cap: In any event, our total aggregate liability shall not exceed the amount paid by you for the Service in the three months immediately preceding the claim, or £100 (whichever is less).

7.3 User Indemnification

You agree to indemnify, defend, and hold harmless BlogFanatic, its directors, officers, employees, agents, affiliates, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

Your use or misuse of the Service
Content published through the Service to your websites
Any breach of these Terms by you
Any violation of third-party rights, including intellectual property rights, privacy rights, or publicity rights
Any claims by third parties regarding content you published
Your failure to review and approve AI-generated content before publication
Any legal action arising from content published to your websites
Loss or damage resulting from your website credentials being compromised

7.4 Security Breach Limitation

While we implement industry-standard security measures to protect your API credentials and data, you acknowledge that:

No system is completely secure, and breaches can occur despite best efforts
You assume all risk of providing us with access credentials to your websites
We are not liable for unauthorized access, data breaches, or security incidents affecting your credentials
We are not responsible for misuse of your API keys by third parties, even if obtained through our systems
You waive any claims against us for damages arising from security breaches, hacking, or unauthorized access
It is your responsibility to use limited-permission API keys and monitor your website access logs
You should immediately revoke credentials and change passwords if you suspect a breach

We will notify you promptly if we become aware of unauthorized access to your credentials, but we shall have no liability for any resulting damages.

7.5 AI Content Disclaimer

AI-generated content is unpredictable and may contain errors, biases, outdated information, or inappropriate material. You expressly acknowledge and agree that BlogFanatic has no control over and accepts no responsibility for the content generated by AI systems. You are solely responsible for all published content.

8. Data Protection and GDPR Compliance

8.1 GDPR Compliance: We comply with the EU General Data Protection Regulation (GDPR). Please see our Privacy Policy for details on how we collect, process, and protect your personal data.

8.2 Your Rights: Under GDPR, you have the right to access, rectify, erase, restrict processing, data portability, and object to processing of your personal data. Contact us to exercise these rights.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience technical issues that temporarily affect service availability. We are not liable for any losses resulting from service interruptions.

10. Termination

10.1 By You: You may terminate your account at any time by cancelling your subscription through your account settings.

10.2 By Us: We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse the Service.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
